The European Commission has responded to recent amendments to the draft law on the Bank of Albania, specifically Article 72, which provides legal protection for the Governor of the Bank of Albania in the exercise of official duties.
In response to a question from Euronews Albania journalist Thimi Samarxhiu, a European Commission spokesperson stated that the institution is aware of the amendments and is reviewing the draft law as part of Albania’s EU accession process.
In the response, the spokesperson also referred to the privileges and immunities enjoyed by the governors of central banks in EU member states under Protocol No. 7 on the Privileges and Immunities of the European Union.
According to the European Commission, these privileges apply to actions carried out by governors in the performance of their official duties as members of a body of the European Central Bank.
European Commission’s Response
“The European Commission is aware of the recent amendments made to Article 72 of the draft law on the Bank of Albania. In the context of Albania’s accession process to the European Union (Chapter 17), the Commission is reviewing the draft law on the Bank of Albania.
The governors of national central banks of EU member states enjoy the privileges and immunities provided for under Protocol No. 7 on the Privileges and Immunities of the European Union, with regard to acts performed in the exercise of their official duties as members of a body of the European Central Bank.
From the date of Albania’s accession to the European Union, Article 72, concerning legal protection in the exercise of official duties, will apply without prejudice to the privileges and immunities enjoyed by the Governor under Protocol No. 7.”
